The High Court upheld the Sessions Court's findings that the appellant's termination was unjustified because there was no evidential basis that the defendants breached the tenancy by denying access or possession, no agreement existed for access via Lot 1170, no evidence supported alleged payments, and defendants were entitled to elect remedies under s40 Contracts Act 1950; accordingly there was no merit to interfere and the appeal was dismissed with costs of RM5,000.
