On the balance of probabilities the applicant established a predicate offence (s23 MACC Act) and that the former PM's First Account contained proceeds of unlawful activity, but the applicant failed to rebut the respondent's specific, documentary averments that the RM4,631,602.00 was payment for legitimate media services and had been expended to pay media owners; therefore the applicant failed to prove the seized funds were proceeds of unlawful activity and forfeiture under s56(2)(a)(iii) and the conjunctive s56(2)(b) condition is not satisfied; application dismissed.
