The applicants were out of time to seek leave for judicial review because the cancellation decisions were, at the latest, communicated to their solicitors on 10 February 2022 (and took effect on 31 December 2021); no satisfactory explanation was given to justify an extension of time, and because compliance with Order 53 r3(6) is jurisdictional the court lacked jurisdiction to entertain the late application; both the leave application and extension application were dismissed with costs.

The Court allowed the State's appeal, holding that applicants failed to comply with mandatory statutory directions under s21 TCPA 1976 so any earlier approval was deemed withdrawn; the SLA letter was not a decision amenable to judicial review; legitimate expectation could not override the statutory scheme; the High Court erred in effectively granting substantive planning approval in circumvention of the TCPA; High Court order of 9.11.2017 set aside and costs awarded to appellants.
