High Court allowed the appeal because the magistrate committed legal error: JPJ retained the seized vehicle beyond the one‑month statutory period in section 80(5) without valid prosecution, and section 80(3) is disjunctive so the magistrate could not properly both temporarily release and later forfeit the vehicle under the same provision; consequently the forfeiture order was set aside and the bail returned.
