The court dismissed the plaintiff's preliminary objection because the plaintiff's conduct (delay in seeking preservation and failure to act with urgency) undermined the contention that the remedy sought was to preserve assets for execution; the sequence of events indicated the plaintiff's motive included preventing defendants from testifying, and there was no clear evidence the defendants were wilfully defying the Court of Appeal order (they sought extensions), therefore exclusion of testimony would be an abuse of process and breach natural justice.
