The Aminah Suit and the Court of Appeal conclusively determined that the subject shares belonged to the defendants (Nur Anis and Ikwan); the plaintiff was privy to or had an interest in that litigation and elected not to intervene and is therefore bound by those findings; consequently the plaintiff's claims in the present suits are barred by res judicata and constitute an abuse of the court's process and disclose no reasonable cause of action, warranting striking out under Order 18 r 19 ROC 2012.
