On the agreed facts the Interim Register and Document of Title were created by mistake and are insufficient/void instruments and amounted to an unlawful acquisition of title; thus the exceptions in s340(2)(b) and (c) apply and under s340(3) the purported title is liable to be set aside and returned to the State; Respondent established no legitimate expectation or detriment and compensation is not adjudicated in this summons.
