On the balance of probabilities the substituted personal representative holding a valid probate grant has the statutory authority and equitable duty to administer estate land; the defendant occupants failed to justify continued possession or to rebut the plaintiff's need to obtain vacant possession to administer or sell the land, and therefore the court ordered delivery of vacant possession within 30 days and awarded costs to the plaintiff; claims for monthly damages were dismissed.
