Clause 13 of the statutory sale and purchase agreement requires purchaser consent for changes to the original plans; clause 29.2 of the deed of mutual covenant insofar as it permits variations without purchaser consent is inconsistent with the statutory agreement and is illegal and unenforceable; failure to obtain purchasers' consent rendered the sale and purchase agreement voidable at plaintiffs' instance; alternatively use of serviced apartments as short‑stay hotel breached clause 4.1 of the deed of mutual covenant.
