The judge found plaintiffs raised bona fide serious questions to be tried and that damages would not be an adequate remedy; there was no evidence of plaintiffs' bad faith or inequitable conduct to justify dissolving the ad interim injunction; the defendant failed to demonstrate a sufficient risk of loss or legal basis for the speculative losses alleged, so fortification of the plaintiffs' undertaking (RM20,000,000) was unjustified and refused; accordingly the interim injunction was granted while fortification and the application to set aside the ad interim injunction were dismissed.
