Liability and causation were conclusively determined against the appellant in earlier proceedings and affirmed on appeal; res judicata and issue estoppel prevent relitigation of those matters at the assessment stage, leaving only quantum to be assessed; market value of the Agri-Land as at the High Court judgment date is the appropriate measure of damages and the respondent’s valuation evidence was preferred; therefore the appeal was dismissed and the High Court assessment upheld.
