The defendant had no caveatable interest because he validly divested ownership and proprietary rights by an absolute Deed of Gift and Deed of Assignment in favour of his son prior to the sale to the plaintiff; the plaintiff was a bona fide purchaser for value without notice and the caveats were wrongfully lodged, therefore the caveats must be cancelled and removed and costs awarded to the plaintiff.
