The Land is registered in the company, not in the deceased; the Respondent’s Sijil Faraid does not confer a present registrable proprietary interest in the Land or any right to enter a caveat; the Respondent was bound by the limited grounds stated in Form 19B which were insufficient; the Applicant, as sole trustee and registered shareholder of the company proprietor, is an aggrieved person whose trustee duties were obstructed by the caveat; accordingly the caveat must be removed.
