The prosecution failed to establish a prima facie case on both charges because critical evidential gaps remained: chemical reports were not proved through their authors, investigative officer conceded lack of knowledge and failure to investigate defence alibi and other potential polluters, sample collection and chain of custody breached accepted procedures, and there was no direct causal linkage between samples from the premises and the closure of water treatment plants.
