The Federal Court held that Article 19(1) Sarawak vests the Dewan with jurisdiction to decide questions of a member's continued qualification irrespective of whether the disqualifying act occurred before or after election; such Dewan proceedings are non-justiciable under Article 72(1) Federal Constitution when the Dewan acts within its constitutional power; disqualification under Article 17(1)(g) for voluntary acquisition of foreign citizenship is continuing and not removed by later renunciation; accordingly the Dewan's decision to disqualify and remove the respondent was lawful and is restor…
