The High Court applied the Court of Appeal authority in Muhamad Nazri to hold that the JMB had no statutory power to impose differential maintenance rates and therefore must impose a single maintenance rate of RM2.80 per share unit on the 2nd Defendant's car park parcels for 1.8.2016–30.9.2019; the Plaintiff has locus standi under s.143(3) SMA; 10% p.a. interest is to be imposed on outstanding maintenance and sinking fund contributions for the specified periods; statutory provisions bar voting and JMC eligibility for owners in arrears and permit inspection of accounts.
