The High Court held the plaintiff complied with procedural requisites and provided sufficient, non‑chronological reasons explaining the delay (including prior leave, the Fortuna injunction period, ongoing negotiations and pandemic restrictions); the SAR erred in treating the 2014 letters as a settlement agreement that extinguished the suits because the subsequent Consent Order overtook those letters; accordingly the SAR's dismissal was set aside and the plaintiff's appeal allowed.
