The Learned SAR erred in directing withdrawal without liberty to file afresh where the record did not show the Plaintiff's consent; the Court exercises discretion under Orders 3 r 5 and 45 r 6 and its inherent jurisdiction to prevent injustice and therefore granted the Plaintiff leave to apply and allowed the extension of time to file the Notice of Taxation and Bill of Cost, subject to conditions including payment of costs of the application.
