The appeal was dismissed because the appellant failed to produce contrary specialist evidence or demonstrate clear flaws in the specialist reports of Dr Park and Ms Lennan; consequently the Court upheld the ACC's finding that the mental injury was not materially caused by the 2009 ankle injury.
