On the balance of probabilities the Court was not satisfied the inguinal hernia was caused by a traumatic rupture from lifting the casket; the updated ACC hernia guidelines and coherent expert opinions that the presentation was more consistent with gradual connective tissue weakness (collagen deficiency) were accepted, so cover was not established.

The appellant failed to prove on the balance of probabilities that the umbilical hernia was caused by the alleged lifting event; the significant delay in reporting and assessment, absence of contemporaneous medical evidence of trauma, and medical opinion and literature supporting a natural genesis meant causation was not established and the appeal must be dismissed.

On the balance of probabilities the evidence did not establish that the appellant suffered a traumatic inguinal hernia as a result of the lifting incident on 18 October 2002; the delay in diagnosis, absence of contemporaneous symptoms or reporting, and the chronology indicating gradual onset meant the respondent was correct to decline cover.
