Because the legislation requires assessments for Independence Allowance to be made using the AMA Guides (Fourth Edition) and Dr Kanji conducted and documented an AMA Guides compliant assessment concluding 0% whole-person impairment, that assessment was binding; Mr Howie's 25% result based on the Oswestry scale did not comply with the statutory method and could not displace the assessor's compliant finding.
