Dr Newburn's report was not an assessment carried out by an assessor appointed under clause 60/reg 3 and therefore did not meet the statutory requirements of reg 4; the Reviewer's substitution of a new WPI based on that report was quashed and the correct course is for the Corporation to obtain a new independence allowance assessment from an ACC-appointed assessor with appropriate expertise; substitution by the court is exceptional and not warranted here.
