The Court ordered the first to third respondents to refund the appellant $156,250.85; refused recovery of the ATE insurance premium as a disbursement because an order to that effect would not be just; awarded the appellant two thirds of scale costs calculated as for a complex appeal on a band B basis with usual disbursements (no uplift), to be fixed by the Registrar, and made no costs award for the application itself.
