The Court, exercising its power under s8 of the Insolvency (Cross-border) Act 2006, appointed an independent solicitor (Mr Michael Whale) to inspect files held by Steindle Williams Legal Ltd and prepare a report identifying documents the joint trustees are entitled to obtain (by waiver of privilege), documents subject to others' privilege, and documents in doubt, and set procedure and timelines for resolution; the Court declined to review the validity of the English adjudication in this assistance application and reserved multiple costs questions.
