Costs were ordered to lie where they fall because no party was a clear overall winner, the outcomes were materially mixed, pre-trial offers and evidentiary deficiencies (notably poor financial records) made allocation of costs inequitable, and although a prior offer exceeded the award this did not warrant shifting costs given fairness concerns and inadequate disclosure.
