Given evidence that the settlors intended all four children to be treated equally, the unanimous support of beneficiaries with capacity, and the lack of detriment to those incapable of assenting when family welfare benefits are considered, the Court exercised its power under s 64A to approve the variation adding Graeme Denys Butler and Shelley Marie Butler as discretionary beneficiaries.
