The default costs rule in r 15.23 applies and r 4.23 makes joinder of beneficiaries unnecessary; because the second respondent was not required to be joined personally, the applicant must discontinue against him and pay 2B costs of $4,541; the Court will not grant a further lengthy adjournment against the first respondents absent their consent because the leave application has been heard and judgment reserved, and the prior lengthy adjournments achieved that purpose.
