Because the liquidators had a genuine and reasonable basis to commence the proceeding to secure appointment of an administrator to pursue claims and they achieved their objective when an administrator was proposed, the interests of justice did not favour awarding costs to the interested parties; accordingly costs are to lie where they fall.

Applicant was entitled to costs for the leave to appeal application; respondents had participated and acted as parties and thus were liable; there was no disqualifying conduct or special reason to reduce or defer costs; accordingly costs of $7,648 and disbursements $550 awarded to applicant, liability joint and several.

The executors had undertaken all reasonable enquiries to locate the missing beneficiary; accordingly the court granted directions under ss 66 and 76 to dispense with further searches and service and ordered that the missing beneficiary's share be included with the residue and distributed to the remaining beneficiaries in accordance with the will.
