Because executors named in the will neglected to prove the will within three months and the order nisi was properly made and service proven, and because the applicant produced sufficient affidavit evidence and a photocopy of the will where the original could not be located and no precise date requirement is imposed, the court granted letters of administration to the applicant under s19 Administration Act 1969.
