The Court declined to order further particularisation because the defendant's amended statement of defence already identified the essential case to be met (remote activation of a lamp, allegation of combustibles nearby, and alleged motive, means and opportunity), the plaintiffs were not entitled to the evidential detail they sought, arson allegations do not require special pleading beyond ordinary rules, and the defendant may provide further particulars after expert testing if appropriate.
