Preventive detention under s75 Criminal Justice Act 1985 was not available to Mr Mist because, read with s4(2) (and s6 and s25(g) and article 15 ICCPR) the age eligibility must be satisfied at the time of the offending; consequently the sentence of preventive detention was quashed and the High Court finite sentence reinstated, with remittal to the Court of Appeal on the Solicitor-General's alternative ground regarding adequacy of finite terms.
