The judge accepted the treating surgeon's detailed, consistent and operative-findings-supported evidence that the accident's mechanism caused the rotator cuff tear; pre-existing degenerative findings were minor or incidental and did not displace causation; accordingly the refusal of prior approval was unlawful, the review decision was quashed, and ACC must fund/reimburse the surgery.
