The Court found on the balance of probabilities that the appellant failed to prove the respondent's spinal stenosis was caused wholly or substantially by degenerative change or ageing; medical evidence (Mr Cowley), accepted by the Court, established the fall caused a lumbar disc injury that precipitated the stenosis, so section 10 exclusion did not apply and the Review Officer's decision was confirmed.
