On an objective assessment the vendor's countersigned ADLS agreement and the purchaser's acceptance (initials and deposit) established a binding contract; the agent merely presented the vendor's countersigned offer within the scope of his authority under the agency agreement and clause 18.1 of the ADLS form, so there was no arguable defence and specific performance was ordered.
