The High Court did not err in finding the first leave question moot as framed because the issue before the Court of Appeal was premised on factual causation (including alleged effects of surgery) that was not adjudicated below and for which the record lacked directed evidence; the appeal is therefore dismissed and the appropriate course for treatment-injury or aggravation claims is fresh proceedings with further investigation.

The appeal was dismissed because the evidence established that the 24 November 2004 incident did not cause a new injury but was an aggravation of the 1981 injury, the Corporation's revocation of cover dated 12 February 2010 was therefore correct, and the matters advanced by the appellant related to entitlements or earlier resolved decisions not before the Court, leaving no live issues requiring further hearing.

Gouldstone v Accident Compensation Corporation

The review decision was quashed because the court requires the Corporation to investigate whether the 1997 injury is an exacerbation of a 1975 injury (which, if previously covered, would negate the applicability of s63) or alternatively to consider the 1997 claim on its merits under sections 7 or 8 of the 1992 Act; accordingly s63 should be set aside for the purposes of that inquiry and the matter remitted for further consideration.
