The court concluded Flight Care lost any common law possessory worker's lien when it voluntarily relinquished possession of the aircraft on 21 December 2011 and failed to establish the Albemarle exception because there was no evidence of an express agreement or pre-release acknowledgment preserving the lien; summary judgment was therefore appropriate for the plaintiff.
