The Court was satisfied the Part 3 criteria were met: the proposed broader purposes are charitable and capable of being carried out; the scheme is proper and not contrary to law or public policy; amalgamation by transfer or resettlement of assets to the new Bashford‑Nicholls Charitable Trust will facilitate administration and reduce costs; conferring power to wind up the original trusts after transfer is ancillary and necessary; accordingly the scheme is approved and orders are made under s53(c).
