The judge accepted the treating surgeon's logical and plausible opinion and found on the balance of probabilities that the supraspinatus tear was traumatic from the 10 February 2012 fall despite the delay in presentation; accordingly the appeal was allowed and ACC was ordered to reimburse the operation costs.
