The Court held the Commissioner had adequate and reliable information in the application (including frequency, duration, scale and proposed management measures) and in the written approvals from relevant agencies to reasonably conclude adverse effects on anglers would be infrequent, short-term and no more than minor; the absence of the angler emails and the subjective views of anglers did not render the non-notification decision unlawful under s95A–95E RMA.

The Society failed to demonstrate that the Commissioner treated Fish and Game's approval as substituting for angler views, failed to take relevant considerations into account, or proceeded without adequate information; the Council lawfully assessed the AEE, operational controls and management measures and reasonably concluded adverse effects would be no more than minor, so non-notification and the substantive consent were valid.

The High Court held the Environment Court did not err in law: it did not apply a novel 'heritage landscape' construct but lawfully applied s6(f) to protect the surroundings/curtilage of listed heritage items; the factual findings supported the Environment Court's conclusion that PC12's restrictions were justified despite limited built heritage on appellants' land; economic effects were considered though unquantified; the 15m setback was a legitimate planning control when justified for heritage protection; appeal dismissed.

The High Court held the Environment Court misinterpreted the district plan by confining its consideration strictly to the eight specified assessment matters for the breached Site Standard (an error of law) and misapplied Woolley by treating Part 2 as relevant only for identifying benefits; however those errors were not shown to be material to the outcome because the omitted matters were either not genuinely in dispute or would not have changed the analysis, so the appeal was dismissed.

The appeal is dismissed because the appellant misread the Environment Court's interim decision; condition 32 was a lawful exercise of the Environment Court's discretion to balance resource use and environmental protection, did not breach s104D or s7(c), and the challenge impermissibly sought to re‑litigate factual assessments and the weight of evidence rather than identify an error of law.

The Court held the Council erred in law by failing to consider the adverse effects on residential amenity of increased traffic and by restricting its visual amenity analysis to screening alone (ignoring broader amenity values and the impact of access gaps), such that there was a real risk of more than minor adverse effects; accordingly the non-notification and the grant were invalid and must be set aside and re-determined with proper notification consideration.

The High Court held the Commissioners had adequate, reliable and sufficiently comprehensive information (including independent peer reviews) to decide non-notification and to grant consent; the finding that adverse effects would be no more than minor was open to the Commissioners; Northcote Mainstreet was not a person capable in its own right of being adversely affected in an environmental sense; procedural fairness was not breached; processing a second application while the earlier consent was under challenge was lawful and not unreasonable; plaintiffs' claims were dismissed.
