The court ordered that the respondent pay the amicus costs attributable to interlocutory steps in full ($8,712.00) and 25% of substantive costs and disbursements (25% of $39,390 = $9,847.50; 25% of $3,682.93 = $920.74), because the respondent needlessly prolonged the proceedings by pursuing meritless collateral matters; the remaining 75% of substantive costs and disbursements are to be paid from public funds. The court also left open contingent attribution of costs to non-party Nigel Baker if the respondent trust cannot meet liabilities.
