The DFA unconditionally required the defendant to market and sell both properties in autumn 2015 and to pay the plaintiff $3,200,000; the defendant failed to perform, offered no tenable defence, and the plaintiff is therefore entitled to damages equal to the shortfall ($1,100,000) plus interest and to ancillary enforcement orders to collect funds held under existing freezing and ancillary orders.
