Leave to subpoena the three named witnesses and leave to administer interrogatories were refused. The proposed oral evidence was unnecessary because the case was founded on documentary evidence, the applicant had not attempted to secure briefs, many proposed questions were irrelevant, abusive or prejudicial, and compelling reasons to require more detailed reasons for a decision not to prosecute were absent given the restrained review applicable to prosecutorial decisions; accordingly both interlocutory applications were dismissed.
