The appeal was struck out because the appellant failed to pay court-ordered security for costs and failed to prosecute the appeal with due diligence for several years, authorising striking out under r 44A(1)(b) of the Court of Appeal (Civil) Rules 2005.

The appeal is dismissed because it was filed out of time, the substantive repair claims were not before the Tribunal and therefore provided no proper basis for appeal, and appeals to this Court under s119 RTA are limited to questions of law so there was no legal basis to allow the appeal.

The appeal is dismissed because the interest issue had been finally litigated and decided previously; all elements of res judicata (final decision on the merits by competent tribunal, same parties, and determination of the question) are present, the appellant exhausted avenues of appeal and time for further challenge has passed, and the later authorities relied upon do not negate the bar of res judicata in these circumstances.
