The High Court held there was no miscarriage of justice: the trial Judge implicitly made credibility findings in favour of the complainant and was entitled to infer intention to apply force from the surrounding circumstances (two objects thrown towards the complainant, CCTV and witness evidence); therefore the conviction for common assault was properly made and the appeal was dismissed.
