The appeal is dismissed because, although the Judge mistakenly referred to prior imprisonment at the indication stage, that error did not make the final sentencing decision to impose imprisonment rather than home detention outside the range of available sentences; the Judge was best placed to assess suitability for home detention and reasonably concluded imprisonment was required to meet accountability and the best interests of the child given the offender's history and circumstances.
