The Corporation was required to apply the law in force when it determined the appellant's entitlement to interest (the 2001 Act); section 371 of the 2001 Act preserves but modifies section 72 of the 1992 Act such that interest is not payable for periods before 1 July 1992, and therefore the appellant's challenge based on earlier application of s72 fails; appeal dismissed.

Leave to appeal was refused because the court followed Robinson v ACC and concluded that s371 of the 2001 Act modified s72 of the 1992 Act so that interest could only be paid for periods commencing on or after 1 July 1992; accordingly there was no proper question of law for the High Court and leave was not granted.

The legislation in force when ACC considered and determined the appellant's entitlement (the IPRC Act 2001) governs; s.371 of the 2001 Act preserves but modifies s.72 of the 1992 Act so interest under s.72 only runs for periods commencing on or after 1 July 1992; therefore appellant is not entitled to interest prior to 1 July 1992 and the appeal is dismissed.
