Because the 2010 Regulations create a specific, comprehensive scheme prescribing costs for covered hearing loss and replaced the audiology item in the 2003 Regulations, entitlement determinations made after the Regulations' commencement are governed by the 2010 Regulations; a fresh decision taken after commencement is subject to the new regime and the presumption against retrospectivity does not preserve application of the old s 81 methodology in this context.
