The habeas corpus application was dismissed because the issues raised required full factual and legal evaluation in the Family Court and existing judicial review proceedings; under s14(1A)(b) of the Habeas Corpus Act 2001 the High Court may refuse habeas corpus where it is not the appropriate procedure, so the court refused the writ without determining lawfulness of detention.
