Because Ms D was at large and there was no constraint on her liberty, s 14(1A) of the Habeas Corpus Act 2001 precluded a habeas corpus application; additionally, orders of the Family Court affecting children must be challenged by appeal or review, not by habeas corpus, and therefore the habeas corpus application was dismissed.
