The High Court held the District Court was entitled to award costs to the respondent but erred in awarding indemnity costs and quantifying costs without applying the scale rules in s13 CCCA; the case did not meet the threshold of special difficulty, complexity or importance to exceed the statutory scale, so the proper award is scale costs of $339 plus disbursements $1,874.40 payable by the Ministry of Justice.
